The writ petition was filed on account of not filling up vacancies in BIFR and AAIFR i.e. when both Boards were non-functional. 2.
On April 18, 2016 notifications have been issued appointing members to BIFR as well as AAIFR. The result is that as of today there is no lack of quorum in both Boards.

Thus, relief claimed in the writ petition cannot be granted for the reason the writ petition was premised on the fact that neither BIFR nor AAIFR are functioning.

But, learned counsel for the petitioner states that members appointed to BIFR and AAIFR are holding charge elsewhere as well and the result is that BIFR is holding sitting every day only for two hours. W.P.(C) 3721/2016

Since the matter projected in the writ petition needs an urgent consideration before BIFR and hence while declining relief prayed for in the writ petition, we direct that on an application filed by the petitioner before the Registrar BIFR, application filed by the petitioner for de-registration on the plea that its networth has turned positive shall be placed by the Registrar BIFR before the Board on any date next week.
