% 18.08.2017 Both learned counsels submit that per settlement agreement dated 20.07.2017 arrived at Delhi High Court Mediation and Conciliation Centre the matter has been settled for a total sum of Rs.1.47 Crore for which 12 post dated cheques have been issued and last of which shall be payable by 05.07.2018. Learned counsel for respondent submits that respondent undertake to abide by the terms and conditions of the settlement agreement dated 20.07.2017.

Learned counsel for petitioner says that he intends to withdraw the petition with liberty to revive it in case there is any default in payment of instalments.

Considering the submissions of learned counsel for parties, the petition is dismissed as withdrawn with liberty to revive the same in case of any default of instalment by respondent. No order as to costs. YOGESH KHANNA, J AUGUST 18, 2017 M
