Petitioner seeks bail in case FIR No.131/2018 under Sections 419/420/468/471/120B IPC registered at PS Punjabi Bagh. The abovenoted FIR was registered when an information was received regarding fake candidate appearing in Class XII examination for Geography subject at Hans Raj Model School, Punjabi Bagh. It was revealed that on the admit card Roll No.9160352 in the name of Akshay Khanna, some other person was appearing. The name of the person who was actually giving the exam was revealed as Krishan Kumar who stated that he was impersonating as Akshay Khanna. During interrogation Krishan Kumar stated that the said task along with the admit card of Akshay Khanna to appear in the exam was given to BAIL APPLN. 846/2018

him by one Sumit. On arrest of Sumit, he disclosed that he had been approached by his friend Ajay Kumar to provide a candidate for the said exam for Akshay Khanna. On the interrogation of Ajay, he disclosed that he was in touch with one Rahul the petitioner herein who approached him in the first week of March to make arrangement of a candidate to give exam of Geography paper of Class XII CBSE Exam and admit card of Akshay Khanna was handed over to him by Rahul. Petitioner has been in custody since 3rd April, 2018. Nothing incriminating has been recovered at his instance.

Considering the fact that till date the material available with the investigating agency is only the disclosure statement of the co-accused, this Court deems it fie to grant bail to the petitioner. It is therefore directed that petitioner be released on bail on his furnishing a personal bond in the sum of ₹25,000/- with one surety bond of the like amount subject to the satisfaction of the learned Trial Court further subject to the condition that the petitioner will join the investigation as and when required and will not leave the country without prior permission of the Court concerned and in case of change of address, the same will be intimated to the Court concerned by way of an affidavit.
