This is a petition filed under Section 11 of the Arbitration & Conciliation Act, 1996, seeking appointment of an arbitrator for adjudication of the disputes and differences which have arisen between the parties in respect of Letter of Intent dated 15.11.2013. 2.

Mr.Vaibhav Jain, learned counsel for the petitioner submits that he has not been in a position to obtain any instructions as the petitioner has failed to respond to his repeated communication. He, further, submits that he has moved an application for discharge, therefore prays that he be discharged.

In my considered opinion, keeping in view the nature of relief sought in the petition, which is for appointment of an Arbitrator as also the stand of Mr. Jain that the petitioner is not responding to his communication, it appears that the petitioner is not interested in DigitallySigned By:MANJU BHATT 16:25:05

pursuing the matter.

The petition along with the pending application is, dismissed for non-prosecution.
