O R D E R

The petitioners have been convicted for having committed offences punishable under Section 323/341/308/34 IPC in FIR No.413/2007 dated July 24, 2007 PS Timarpur, New Delhi.

They have challenged their conviction in Crl.A.No.11/2010.

Stating that petitioners have amicably resolved the dispute with the complainant and the other aggrieved persons, impleaded as respondents 2 to 4 in the petition, quashing of the FIR and proceedings emanated therefrom is prayed for.

In my opinion the petition is misconceived for the reason against the conviction and order of sentence the petitioners have filed Crl.A.No.11/2010.

The petitioners are advised to move an appropriate criminal miscellaneous application in the said appeal and it would be for the Appellate Court to consider whether in view of the compromise the appeal needs to be disposed of setting aside the judgment of conviction and the

sentence imposed.

The petition is dismissed.
