% 21.05.2018 After some hearing, the counsel for the petitioner submits that he may be allowed to withdraw the present petition and the applications filed therewith and seeking liberty to move a review application before the rent controller to point out that Gurbachan Singh who was impleaded as first respondent in the eviction petition had died on 28.03.2011 and that the correct name of co-tenant i.e. the petitioner herein is Smt. Suvinder Kaur and not Smt. Surinder Kaur in whose name the summons were issued on the petition under Section 14 (1) (e), Delhi Rent Control Act, 1958. The review application may be filed within fifteen days hereof during which period the eviction order shall not be executed. In the event of application for review being filed, the stay against execution will continue till decision is taken by the rent controller on such review application. The petition and the applications filed therewith are dismissed as withdrawn with liberty as prayed for granted. RC.REV. 232/2018

Compliance under Order XXXIX Rule 3 CPC shall be made by the petitioner within three days.
