Vide orders dated 09.09.2025 and 23.12.2025, the Hon'ble Court has, inter alia, directed as under:- "09.09.2025 .....

Accordingly, as per the mandate of the judgment of the hon'ble Supreme Court in Kazi Moinuddin Kazi Bashiroddin & Ors. vs. Maharashtra Tourism Development Corporation & Anr.; 2022 SCC OnLine SC 1325, the application is allowed and the 50% of decretal/enhanced amount already deposited by the appellant vide Order dated 20.03.2025 and 21.08.2025 be released along with interest accrued thereon in proportion to the respondent Nos. 1 to 3/LRs of the respondents on the furnishing indemnity bond subject to the satisfaction of the Registrar General of this Court, after necessary verification....." Maharashtra Tourism Development Corporation & Anr.; 2022 SCC OnLine SC 1325, the application is allowed and the 50% of decretal/enhanced amount already deposited by the appellant vide Order dated 20.03.2025 and 21.08.2025 be released along with interest accrued thereon in proportion to the respondent Nos. 1 to 3 on the furnishing indemnity bond, subject to the satisfaction of the Registrar General of this Court, after necessary verification.

Learned counsel for the respondent Nos.1 to 3 has submitted that in compliance of the aforesaid orders passed by the Hon'ble Court, an indemnity bonds dated 26.12.2025 and an undertaking by way of an affidavits dated 26.12.2025 have been e-filed by respondent Nos.1 to 3, for the release of their 1/3rd share each in the 50% of the enhanced decretal amount i.e ₹2,09,30,475/- alongwith accrued interest to respondent Nos.1 to 3. Learned counsel has placed on record original indemnity bonds and undertaking by way of an affidavits.

Respondent Nos.1 to 3, who are also present in person, submitted that the aforesaid decretal amount be released to them in equal share i.e. 1/3rd share each, and that they shall refund the amount so released to them to the appellant, or as may be directed by the Hon'ble Court, in the event the appellant succeeds in the present appeal. Nos.1 to 3 in this regard have been recorded separately and they have been identified by their counsel.

It is also pertinent to mention that no objection has been raised on behalf of the other party in regard to the release of the aforesaid 50% of the enhanced decretal amount as directed by the Hon'ble Court. 5.
In view of the indemnity bonds, undertaking by way of an affidavits filed by the respondent Nos.1 to 3 in compliance with the aforesaid orders of the Hon'ble Court and also considering the statements made by respondent Nos.1 to 3 qua refund of the amount in the event of the appellant succeeding in the present appeal, there is no impediment in releasing the aforesaid 50% of enhanced decretal amount alongwith accrued interest to respondent Nos.1 to 6.
Registrar (B&A) is directed to release the 50% of the enhanced decretal amount i.e. ₹2,09,30,475/- alongwith accrued interest to the respondent Nos.1 to 3 in equal share in terms of the aforesaid orders passed by the Hon'ble Court after due verification and receipt.
