% 22.12.2017 In terms of orders of this court dated 21.12.2017 the respondent has today tendered to the petitioner in Court five post dated cheques of Rs.5 lacs each being a total of Rs.25 lacs.

Mr.Ankur Gupta, CFO of the respondent company is present in Court. He undertakes to the Court that the post dated cheques when presented for encashment would be duly encashed.

The undertaking of the CFO of the respondent company is taken on record. The respondents will ensure that the Post Dated Cheuqes are duly encashed, when presented by the petitioner.

In view of the above, learned counsel for the petitioner seeks to withdraw the present petition with liberty to take steps, as per law, including

revival of this petition in case for some reason the Post Dated Cheques are returned unpaid.

Granting leave and liberty as sought for, the present petition is disposed of. All pending applications, if any, also stand disposed of. Order dated 27.11.2017 admitting the present petition is recalled. JAYANT NATH, J DECEMBER 22, 2017 n
