The petitioner/applicant has challenged the impugned judgment and decree dated 18.12.2017 by which her suit for declaration and recovery of possession was dismissed by the Court of learned Additional District Judge-09, Central District, Tis Hazari Courts, Delhi. She states that she is a widow and an illiterate. She further states that she has no source of income even for her day to day requirements. She is earning her livelihood as a maid in the adjoining house. She has no jewellery and bank account. She does not own any immovable property except the property in question. 2.

The learned counsel for the petitioner/applicant contends that even in Trial Court, the applicant was permitted to sue as an indigent

person. The application is duly supported by her affidavit. 3.

In the circumstances, the application is allowed and the applicant is permitted to file an appeal as an indigent person. 4.

The present CMI is disposed of.
