Petitioners seek quashing of FIR No.334/2011 under Sections 323/341/506//34 IPC, Police Station Ghazipur, based on a Settlement. Subsequently, Section 308 IPC has been added. 2.
Subject FIR has been registered consequent to a quarrel which took place between the parties.

Parties are neighbours.
The nature of the injury sustained is simple.

With the intervention of respectable members of the locality
and well wishers of both the parties, the parties have settled their disputes.
Compromise/Settlement Deed dated 22.01.2018 has been executed between the parties.

The Settlement records that the dispute occurred on the spur of the moment and with the intervention of some respectable members of the locality and well wishers of both the parties, the parties have settled their disputes.

Respondent No.2 is present in Court in person, is identified by the Investigating Officer. She confirms that she has settled the disputes with the petitioner and does not wish to press her complaint any further.

In view of the above and keeping in view of the fact that the parties have resolved their dispute with the intervention of respectable members of the locality and Compromise/Settlement Deed dated 22.01.2018 has been executed between the parties and further respondent No.2 does not wish to press her complaint against the petitioner, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating therefrom.

Accordingly, FIR No.334/2011 under Sections 323/341/506//34 IPC, Police Station Ghazipur, and the consequent proceedings
emanating therefrom are hereby quashed, subject to the petitioners depositing costs of Rs.25,000/- in total, which shall be paid to the "Delhi High Court Advocates Welfare Trust", within a period of three weeks from today. Receipt of deposit of the costs imposed by this Order be furnished to the concerned Investigating Officer within a period of four weeks from today.
