% 27.05.2016 I.A. No. 6822/2016 This application has jointly been moved by the applicants under Order XXIII Rule 3 CPC to record their settlement. The application has been signed by the representatives of the parties and their respective counsel. It is also supported by the affidavit of Jalaluddin Akbar, the authorised signatory/ director of the plaintiff and the affidavit of Zoheb Ahmed, the authorised signatory of defendant No.1.

Learned counsel submits that the main contesting defendant is defendant No.1 and the defendants No.2 & 3 are also consenting to the settlement.

The terms of settlement appear to be fair, just and reasonable and

there is no impediment in accepting the same. Accordingly, the suit stands disposed of in terms of the said settlement which shall continue to bind the parties.

Since the disputes have been settled prior to commencement of trial, the plaintiff shall be entitled to refund of 50% of the Court Fees. VIPIN SANGHI, J MAY 27, 2016 B.S. Rohella
