This matter is taken up today in view of Notification No.1078/G-4/Genl./DHC dated 6.7.2016.

After arguments, counsel for the appellant states that appellant is not pressing the appeal on merits but prays for six months time to vacate the suit premises.

Accordingly, while disposing of the appeal as not pressed, with consent appellant is given time to vacate the suit premises on or before 15.1.2017. Appellant in order to get benefit of time for vacating the suit RSA No.102/2016

premises will file his affidavit in the Court within two weeks that he undertakes to vacate the suit premises on or before 15.1.2017 and will continue to pay all charges for use and occupation, electricity charges, water charges etc as were fixed under the agreement with the landlord to the landlord.

This appeal is disposed of in terms of aforesaid directions. 5.
