O R D E R

By this petition the petitioners Leela Devi and Ketan Meena, resident of 69, Yusuf Sarai, New Delhi seek protection against respondent No.2 Rajiv @ Anu nephew of the husband of petitioner No.1 Leela Devi. 2.

As per the petition, marriage of petitioner No. 2 is fixed for 30th April, 2018 and the engagement ceremony is fixed for 26th April, 2018. To create nuisance on coming to know about the engagement and marriage of petitioner No. 2, respondent No. 2 has started harassing and intimidating the petitioners.

Notice was issued to respondent No. 2 who refused to accept dasti service, thus respondent No. 2 is deemed to be served. 4.

Status report has been handed over by the State which is taken on record. As per the status report on 8th April, 2018 a PCR call was received W.P.(CRL) 1182/2018

which was recorded vide DD No. 45 A and 51A regarding threat and quarrel. ASI Harinder reached the spot, that is, House No. 69, Yusuf Sarai, New Delhi where large crowd had gathered and abusive words were being used. Respondent No. 2 was shouting that the shop belonged to him and that he would get it vacated and that he would see who save them. Despite ASI Harinder trying to pacify respondent No. 2, he was adamant and approaching to attack the petitioner No. 1. Thus respondent No. 2 was arrested and action under Sections 107/151 Cr.P.C. was instituted against him.

As per the inquiry late Ram Ji Lal Meena, Sita Ram Meena, late Gopal Meena and late Prabhati Lal Meena were four brothers, out of which only Sita Ram Meena is surviving but the families of all the four brothers are residing at House No. 69, Yusuf Sarai, Delhi. There are four shops on the same address, one in possession of Manish son of late Gopal Meena and the remaining in possession of Leela Devi, wife of Sita Ram Meena. There is a dispute interese the family members regarding possession of the shops. 6.

Considering the impending threat and the fact that respondent No. 2 may create nuisance during the course of engagement and marriage of petitioner No. 2, this Court deems it fit to allow the petition. SHO, PS Hauz Khas is directed to ensure the protection of the petitioners through beat staff and in case of any specific complaint is received action thereon be taken in accordance with law.
