This is an application for recording of compromise between the appellants and the respondent nos.1 and 2. The disputes between the parties pertain to ownership of 9 bighas and 4 biswas of land situated in khasra nos.211 to 214 and 217 in the revenue estate of village Bakoli, Delhi. The appellant no.5/plaintiff no.5 claimed half ownership of the suit land and therefore sought cancellation of the sale deed dated 24.9.1998 executed by respondent no.2 in favour of the respondent no.1 with respect to the entire property.

Dehors the prayer clause of this application, it is agreed that the suit as also the present appeal be disposed of by declaring appellant no.5 to be the 50% owner of the suit land and respondent nos.1 and 2 jointly to be the owners of remaining 50% of the suit land i.e the suit and the present appeal be disposed of by declaring half ownership rights each between the appellant no.5/plaintiff no.5-Mr. Prem Chand Singhal and the other half to be jointly owned by the respondent nos.1 and 2/defendant nos.1 and 2 i.e Smt. Suchitra Devi and Sh. Tirath Raj. It is also agreed that appellant no.5 with respondent nos.1 and 2 would be in joint physical possession of the suit land and property.

Appeal is disposed of as not pressed as against the proforma respondent no.3/Punjab National Bank.

In view of the above, this appeal is disposed of as compromised in terms of aforesaid order.
