Learned counsel for the petitioner also acknowledges the abovesaid legal position. He also submits that while he does not press the present petition, he may be granted liberty to file appropriate petition under Article 227 of the Constitution of India to challenge order dated 16.12.2022 whereby their application under Order VII Rule 11 CPC was dismissed by the learned Trial Court. 3.

The petition, in view of the aforesaid, is disposed of as not pressed. Liberty, as prayed, is granted.
