% 10.10.2018 A joint application has been filed by the petitioners and the respondent nos. 1, 3, 4 and 5 placing on record the terms of the settlement arrived at between the parties. They jointly pray that a Local Commissioner may also be appointed by this Court for undertaking the exercise that is mentioned in the application and the petitions be disposed
of in terms of the settlement.
As far as respondent no. 2 is concerned, learned senior counsel appearing for respondent no. 2 submits that without prejudice to his rights and contentions, he has no objection if the settlement is given effect to. As far as the other inter se disputes between the respondents are concerned, he submits that the same shall be taken up by respondent no. 2 in appropriate proceedings.
Recording the settlement between the parties and binding them to the terms thereof, the present petitions and pending applications are disposed of.
I appoint Mr.Sarad Kumar, Advocate (R/o A-80, Defence Colony, New Delhi Mobile: 9958178853) as a Local Commissioner to carry out the investigation as jointly prayed for by the parties in the application. The Local Commissioner shall visit the subject premises on 13.10.2018 at 11:00 a.m. He need not give any further notice of his visit to the parties.
The Local Commissioner shall be paid a fee of Rs. 75,000/- to be borne by respondent no. 1. Apart from the fee the Local Commissioner shall also be entitled to any other out of pocket expenses. Local Commissioner on completion of investigation shall prepare a report and give a copy of the same to the parties. He shall also file a copy of the same before this Court.
