% 19.07.2016 Petitioner is aggrieved by the notice which has been issued to him 02.6.2014 by the Block Development Officer (BDO) against this notice challenged was laid before the Financial Commissioner. The Financial Commissioner in his order dated 04.7.2014 was of the view that since only the petitioner made by the petitioner is pre-mature it is accordingly dismissed by the Financial Commissioner. Learned counsel for the respondent has pointed out that the notice dated 02.6.2014 is confined to Khasra No.51/18, Village Prahlad Pur Banger, Delhi alone and the present writ petition is beyond the scope of that notice as this has encompassed three lands i.e. Khasra Nos.51/18, 51/23 and 52/24, Village Prahlad Pur Banger, Delhi.
After some arguments, learned counsel for the petitioner submits that the present petition be treated as representation made before the BDO.
The BDO will consider the representation of the petitioner in terms of the writ petition and decide in accordance with law. Although the petitioner is admittedly in an unauthorized colony but he is stated to be protected qua possession in terms of the National Capital Territory of Delhi Laws (Special Provisions) Act, 2011. This aspect shall be considered by the BDO in accordance with law. Petition disposed of.
