O R D E R

% 25.04.2018 Vide the present application, the applicant seeks grant of anticipatory bail submitting to the effect that he has been falsely implicated in the present case and he has no role whatsoever in relation to the commission of the theft of the mobile phones from the shop of the complainant, and that there are no allegations against the applicant qua the offences punishable under Sections 380/457 of the Indian Penal Code, 1860 and the role of the applicant alleged is only qua commission of the offence punishable under Section 411 of the Indian Penal Code, 1860 in relation to which he had allegedly sold the mobile phone to co-accused Amit as stated by the co-accused pursuant to his disclosure statement.

On behalf of the State, it has been submitted that there are 49 other mobile phones which have been stolen which had to be recovered from the applicant. It has also been submitted on behalf of the State that the mobile BAIL APPLN. 878/2018

phone recovered from the co-accused Amit and had been sold to him by the applicant for a sum of Rs.8,200/- and there is a receipt in relation thereto dated 12.02.2018 also on record.

It has been submitted on behalf of the applicant that the real sister of applicant is to be married on 29.04.2018.

Considering the totality of the circumstances of the case, the applicant be not arrested till the date 30.04.2018 subject to his not leaving the area of the NCR of Delhi. The interim protection would stand withdrawn on 01.05.2018. The application is disposed of.
