% 24.04.2018 Notice. Learned APP accepts notice for respondent no.1. Respondent no.2 is present in Court along with her counsel who accepts notice. Respondent no.2 has been identified by SI Samrat Khatiyan of police station Harsh Vihar.
It is submitted that petitioner and respondent no.2 are neighbours. Present FIR No. 259/2017 under Section 354 IPC was registered on the complaint of respondent no.2 at police station Harsh Vihar. It is further submitted that petitioner and respondent no.2 have now settled their disputes amicably vide Settlement Deed dated 17th April, 2018. Respondent no.2 submits that she has settled the matter with the petitioner of her own free will and without any undue force, pressure or coercion, therefore, she is not
willing to pursue the FIR and the same may be quashed. Affidavit of respondent no.2 has also been annexed with this petition in this regard. Keeping in view the settlement arrived at between the petitioner and respondent no.2 voluntarily, I am of the view that no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Miscellaneous applications are disposed of as infructuous.
