% 12.10.2018 Today Mr.Ankit Jain, Advocate appears for the decree holders and states that he has no instructions as he has already been discharged in the present case.

It is pertinent to mention that the present execution petition had been filed seeking execution of the judgment dated 10th January, 2014 passed by a Coordinate Bench of this Court.

Admittedly, in an appeal being RFA(OS) No.119/2015 dated 11th December, 2015 filed by the judgment debtor, the impugned judgment and order dated 10th January, 2014 passed by the learned Single Judge has been set aside and the suit has been dismissed. Thereafter, the learned predecessor of this Court was informed on 06th September, 2016 that the decree holders were in the process of filing a special leave petition. Consequently, the learned predecessor of this Court adjourned the matter sine die with liberty to either of the

parties to mention it after disposal of special leave petition. None of the parties have approached this Court till date. No order of the Supreme Court has been placed on record. Consequently, in accordance with the Division Bench order dated 11th December, 2015 in RFA(OS) No.119/2015, the present execution petition is dismissed.
