By this application, the complainant/applicant has sought recalling of the order dated 4th December, 2017 whereby this Court quashed FIR No. 346/2014 under Sections 498A/406/34 IPC registered at PS Binda Pur on the complaint of respondent No. 2/applicant as the petitioner/non-applicant is not agreeing to quashing of the FIR against the family of the complainant which is pending before the High Court of Punjab and Haryana. Learned counsel for the applicant informs that the next date of hearing before the High Court of Punjab and Haryana is 22nd February, 2019. W.P.(CRL) 1117/2016

Learned counsel for the non-applicant assures that on the next date of hearing before the High Court of Punjab and Haryana the non-applicant and his mother will be present in Court and will make a statement that they do not wish to pursue the FIR No. 217/2013 under Sections 323/325/506 IPC registered at PS Hasanpur, District Palwal, Haryana. 3.

Reply affidavit, if any, be filed by the non-applicant within six weeks. Rejoinder affidavit be filed within four weeks thereafter. 4.

It is clarified that if the non-applicant does not perform his part of the obligation this Court will be constrained to recall the order dated 4th December, 2017 quashing FIR No. 346/2014 under Section 498A/406/34 IPC registered at PS Binda Pur.
