BAIL APPLN. 882/2018 1.

The petitioner seeks interim bail in case FIR No. 2487/2018 under Sections 302/34 of the IPC and Sections 25 and 27 of the Arms Act, Police Station Mangol Puri, New Delhi on the ground of marriage of his brother. It is observed that though the factum of marriage has been confirmed, however, the function is today in the evening.

The petitioner has approached very late and for the sole reason that the petitioner has approached late, I am not inclined to release the petitioner on interim bail.

Nominal roll of the petitioner has been received from the Superintendent (Jail) and also the status report filed by the Investigating Officer. It is observed that along with the status report, a report from the State Crime Record Bureau, Delhi, has been filed, in which the involvement of the petitioner has been shown in five cases whereas the nominal roll received from the Superintendent (Jail) does not capture all the five cases.

Report from the SCRB shows that the petitioner is in judicial custody in case FIR No. 158/2014, the discrepancy in the two reports shall be duly taken into account by the concerned Superintendent (Jail) as well as concerned DCP (Crime). Both of whom shall take appropriate steps to ensure that the records are reconciled and such discrepancies do not occur.

The petition is disposed of.

Copy of the order, along with copies of the status reports of the SCRB and Superintendent (Jail) be sent to the concerned Superintendent (Jail) as well as concerned DCP (Crime) for appropriate action at their ends.
