Petitioner is defending a suit which is summary in nature. 2.

She moved an application seeking leave to defend and her such application moved under Order XXXVII Rule 3 (5) CPC has been disposed of by directing her to deposit a sum of Rs.10 lacs, in shape of FDR within one month.

Such order is under challenge.

After hearing arguments for some time, learned counsel for petitioner, without prejudice to her rights and contentions, submits that she does not press the present petition but seeks extension of time to deposit the abovesaid amount of Rs. 10 lacs by way of FDR in her own name before the learned Trial Court.

Learned counsel for petitioner submits that the learned Trial Court has not passed any adverse order against the defendant for non-compliance of the impugned order.

The next date before the learned Trial Court is stated to be 06.05.2025. 7.

Keeping in mind the overall facts of the case and the aforesaid statement made by the learned counsel for petitioner, the present petition is disposed of as not pressed and, simultaneously, the defendant Ms. Malti Devi @ Malti Yadav is granted time till 06.05.2025, to submit such FDR of Rs.10 lacs before the learned Trial Court.

However, defendant shall file written statement before the learned Trial Court within one month from today, if not already filed, and no further extension in this regard would be given to her on any ground whatsoever, as the matter has already got delayed considerably. 9.

A copy of this order be given dasti under the signatures of Court Master and a copy be also sent to learned Trial Court for information.
