O R D E R

% 17.04.2017 The present petition is filed under section 14 and 15 of the Arbitration and Conciliation Act, 1996 seeking termination of the mandate of Shri R.P.Khurana the sole Arbitrator. It is urged by learned counsel for the petitioner that an initial round of arbitration took place which resulted in an Award being passed by the Sole Arbitrator on 23.06.2011 who was appointed by the respondent. On objection being filed to the said Award the same was set aside by the court of ADJ on 17.8.2013 with liberty to initiate fresh arbitration proceedings. Learned counsel submits that now they have initiated fresh proceedings whereby Shri R.P.Khurana, Deputy Chief Engineer, Northern Railways has been appointed as the sole Arbitrator. The grievance of the petitioner is that the said Arbitrator is proceeding in a very slow pace and the petitioner also apprehends that a non-speaking order may be passed by the Arbitrator.

Learned counsel for the respondent submits that they have no objection in case directions are passed requesting the Arbitrator to expeditiously dispose of the matter.

In view of the above, as agreed to by learned counsel for the parties, the Arbitrator is requested to expeditiously hear the matter and dispose of the same by an Award within six months from today. Petition stands disposed of.
