The status report has been filed on behalf of respondent no.2 (SDM) wherein it has been unequivocally stated that no damage has been noticed in respect of the property of the petitioner. The learned counsel appearing for respondent no.3 (Mr Jatav Dey, the builder) states that the excavation in the property in question is almost complete and a JCB is not being used. 3.
The petition is dismissed for non-prosecution as well as on the basis of the statement made by the learned counsel for respondent no.3. The pending applications are also disposed of.
