By this petition, the petitioner seeks anticipatory bail in case FIR No. 236/2017 under Sections 498A/406/376/342/323/509/34 IPC registered at PS Govindpuri.

The above noted FIR is a part of matrimonial dispute between the complainant and her husband Akshay who happened to be a family friend of the petitioner.

The allegations of the complainant were that the petitioner was having an affair with her mother-in-law and besides levelling allegations of physical and mental cruelty by the in-laws she alleged that she was forced to have physical relationship with the petitioner.

Learned counsel for the petitioner has handed over a copy of the Memorandum of Understanding dated 24th September, 2018 arrived at between Akshay and the complainant wherein pursuant to the settlement divorce by mutual consent have been granted between them. The custody of BAIL APPLN. 902/2018

the minor child from the wedlock has also been decided. Besides settlement of all the claims between the parties, the complainant has also undertaken to withdraw all cases filed by her including the above noted FIR. 5.

Copy of MOU dated 24th September, 2018 is taken on record. Since the matrimonial dispute between the complainant and her husband has been settled, the petitioner has already joined the investigation and charge sheet has been filed, this Court deems it fit to grant anticipatory bail to the petitioner.

It is, therefore, directed that in the event of arrest the petitioner be released on bail on his furnishing a personal bond in the sum of ₹25,000/- with one surety bond of the like amount, subject to the satisfaction of the Arresting Officer/SHO concerned/Concerned Court, further subject to the condition that the petitioner will join the investigation as and when directed by the Investigating Officer and in case of change of residential address the same will be intimated to the Court concerned by way of an affidavit. 7.

Petition is disposed of.
