% 17.07.2018 The petition under Section 482 of the Code of Criminal Procedure, 1973 (Cr.P.C.) seeking quashing of the proceedings arising out of FIR No.114/2012 for offences punishable under Sections 186/353/147/148/149/ 323/ 307/34 IPC and 25/27 of the Arms Act of Police Station Sonia Vihar is wholly misconceived against the background facts that concededly, the police on conclusion of the investigation submitted a charge-sheet on which the competent court took cognizance, issuing summons against the petitioner, even the question on charge having been considered, charge having actually been framed and the case being at the stage of prosecution evidence.

The question of facts raised hear will have to be determined at the trial on the basis of evidence.

The petition and the application filed therewith are dismissed. R.K.GAUBA, J.
