There is no representation on behalf of the petitioner. The previous order dated 24.8.2017 shows that arbitration proceedings are pending between the parties which deals with the same subject matter, as is adverted to in the Company Petition. The petitioner‟s counsel was required to take instructions as to whether or not the petitioner would like to pursue the captioned petition. Mr. Sanchay Mehrotra, who appears for the respondent company affirms that proceedings stand concluded before the arbitrator and that the matter has been reserved for pronouncement of award. 2.

Having regard to the fact that there is no representation on behalf of the petitioner, the company petition is dismissed for nonprosecution. The pending company application is, consequently, closed.
