After arguments, counsel for the appellant took a pass over to take instructions whether the appeal has to be pressed or not, and counsel for the appellant says that she has received instructions not to press the appeal.

I may note that subject suit was filed by the appellant/plaintiff to seek setting aside of the judgment passed by the Consumer Forum, upheld by the State Commission, thereafter upheld by National Commission with costs imposed upon the appellant, and which order of National Commission was sustained by the Supreme Court. 3.

Obviously, in such facts situation no suit can be filed by an unsuccessful party for setting aside earlier judgments passed by competent Courts/Tribunals allegedly on the ground that fraud was committed on the appellant/plaintiff.
