% 29.11.2016 Learned counsel for the respondent submits that possession of the premises has already been handed over to the appellant on 18.11.2016 and as such the matter may be disposed of. Learned counsel for the appellant, however, submits that the applications under Section 340 Cr.PC filed by the appellant be kept pending. Request for an adjournment is made by on the ground that arguing counsel for the appellant is not available and he is in the Supreme Court. Vide order dated 19.04.2016, the record of Criminal Complaint being CC No. V240/2015 Police Station Seelampur, titled 'Mst. Rizwan Fatima v Rahat Ali & Ors' under Domestic Violence Act was requisitioned by this Court. Same be sent back immediately and in case of need same be requisitioned again. Relist on 15.02.2017.
