The petitioner seeks anticipatory bail under Section 438 Cr.P.C. in case FIR No.110/2016 registered under Section 370 IPC & Sections 23/26 JJ Act, 1986 at PS Shalimar Bagh. Status report not filed.

I have heard the learned counsel for the parties and have examined the file. By an order dated 07.04.2016, the petitioners were granted interim protection and were directed to join the investigation as and when required.
The State was directed to file status report indicating the stage of trial/ investigation and to verify the age of the victim. Despite grant of three months adjournment, the State did not prefer to file any status report. Learned APP is unable to answer the queries in the absence of the Investigating Officer. Learned counsel for the petitioner informed that `27,000/- were paid to the victim before the Child Welfare Committee. Learned APP is unable to confirm / deny this fact.

Considering the facts and circumstances of the case, the petitioners are granted anticipatory bail and in the event of arrest, they be released on furnishing personal bond in the sum of `40,000/- with one surety each in the like amount to the satisfaction of the SHO/Investigating officer.
They shall, however, join the investigation as and when required.

The bail application stands disposed of.
