CORAM:
HON'BLE MR. JUSTICE S.P.GARG
O R D E R
% 26.04.2017 1.
Present petition has been filed under Section 482 Cr.P.C. for quashing of FIR No.107/2011 registered under Sections 498A/406/34 IPC and Section 4 D.P.Act at PS Jyoti Nagar. It is stated that the matter has been settled amicably with the complainant / respondent No.2.
2.
Complainant / respondent No.2 is present in person and has been identified by the Investigating Officer. I have enquired from the complainant if she has settled the dispute with the petitioners amicably without any fear or pressure. She has informed that all the disputes between the parties have been resolved amicably with her free consent and she has no objection to the quashing of the FIR in question. Divorce by mutual consent has already been granted. 3.
Only grievance of the complainant is that in the FDRs in the CRL.M.C. 1366/2016
sum of ` One lac each, petitioner No.1 has been made guardian of the child. She seeks to be made a guardian of the child in the said FDRs. 4.
Learned counsel for the petitioners, on instructions, informs that the petitioners have no objection and in the FDRs, guardian will be respondent No.2 (Ms.Meenakshi).
5.
Let the needful be done and respondent No.2 (Ms.Meenakshi) be notified as guardian of the child in whose name the FDRs have been prepared.
6.
The petition is supported by affidavits of the parties. Since the dispute between the parties has been settled before Mediation Centre at Karkardooma Courts on 10.09.2014, no useful purpose will be served to continue with the proceedings. In the interest of justice and to enable the parties to settle in life after divorce, FIR No.107/2011 registered under Sections 498A/406/34 IPC and Section 4 D.P.Act at PS Jyoti Nagar and all the proceedings arising therefrom are quashed. 7.
The petition stands disposed of accordingly.
