The present application is filed under section 151 CPC for direction to the respondent/landlord to refund Rs.3,08,800/- as paid by the petitioner as use and occupation charges in terms of the order dated 05.12.2018 along with interest @ 24% per annum.

This Court vide order dated 05.12.2018 has directed the petitioner to pay the use and occupation charges @ Rs.5000/- per month each for two shops thus totalling to Rs.10,000/- for two shops per month with effect from 01.08.2018 till the disposal of this petition. 3.

This Court vide order dated 20.11.2023 has allowed the present petition and accordingly, set aside the impugned order dated 20.02.2018. 4.

The counsel for the respondent on instructions from the respondent stated that the amount as detailed hereinabove shall be paid in instalments and the respondent shall pay Rs.50,000/- per month which shall be payable on or before the 15th day of each English calendar month commencing from The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
