O R D E R

% 23.04.2018 It is submitted that matter has been settled between the petitioner and M/s Varun Beverage Limited, through respondent no.2, before the trial court on 12th December, 2017, therefore, FIR No. 286/2004 under Sections 465/468/469/471/273/34 IPC and Section 63 of the Copy Right Act registered at police station Shahdara may be quashed. Learned counsel for that petitioner submits that co-accused Sanjay Aggarwal has already been discharged by the trial court; whereas other co-accused Narender has been declared proclaimed offender, thus, trial is going on only against the petitioner.

Mr. Rakesh Sharma, Authorised Representative of M/s Varun Beverage Limited is present in Court and has been identified by SI Amit of

police station Shahdara.

He admits having settled the matter with the petitioner. He has no objection in case FIR is quashed against the petitioner. In view of the compromise arrived at between the petitioner and respondent no.2 voluntarily, I am of the view that no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed qua the petitioner, subject to costs of `25,000/- to be deposited by the petitioner with the Delhi High Court Legal Services Committee within four weeks.

Receipt, evidencing deposit of costs, be handed over to the Investigating Officer.

Petition is disposed of in the above terms.
