% 29.04.2016 In the present case the petitioner has challenged the order 13.01.2016, whereby the learned ACMM (West), Tis Hazari Courts, Delhi has observed that the material available on record is sufficient to frame charge against the petitioner in all the four cases i.e. RC7(A)/89 to RC-10(A)/89 for offence punishable under Section 120-B read with Sections 420, 467, 471 and 477A of Indian Penal Code. Perusal of order sheets reveals that the matter came up for hearing before the learned ACMM (West) for the purpose of framing of charges on 28th January 2016 when the matter was adjourned on the application of the accused seeking exemption from personal appearance. Thereafter, the matter came up on 17th February, 2016, when the same was adjourned to 14th March, 2016 on the medical

ground of the accused. Again the matter came up before the Court on 14th March, 2016 and on the request of the accused, the same was adjourned to 07th April, 2016. In the meanwhile, the petitioner has filed the instant petition.

During the course of arguments, the learned counsel for the petitioner has submitted that he does not wish to press the petition at this stage and, on instructions, he seeks permission to withdraw the present petition with liberty to argue on charges framed against the accused in pursuance to the order dated 13.01.2016. In view of the aforesaid stand taken by counsel for the petitioner, the present petition is dismissed as withdraw with liberty to avail legal remedies as available to him, after framing of charges against him.

With aforesaid directions, the present petition stands disposed of.
