% 11.01.2017 By the present petition, the petitioners seek to challenge the order dated 30.01.2015 by which the application of the petitioner under Order 15A CPC was disposed of.

Learned counsel for the parties have agreed that without prejudice to their rights and contentions, as the suit in the meantime has reached the stage of final disposal, the present petition would be withdrawn by the petitioner subject to clarification that any observations made by the trial court in its impugned order dated 30.01.2015 shall not in any manner influence the trial court will finally adjudicating the suit pending before the trial court.

Clarifying the above position that the trial court may dispose of the suit without being influenced by any observations made in the impugned order, the present petition is dismissed as withdrawn. All pending applications also stand dismissed. JANUARY 11, 2017/rb JAYANT NATH, J
