% 03.03.2016 In view of the order passed in the connected petition i.e. RC. Rev No. 127/2015 the impugned judgement dated 19.09.2014 is set aside in the present case. This Court has not examined the merits of the controversy. The respondent has fairly conceded that since the application seeking leave to defend filed by Respondent No.2 is to be considered afresh, he has no objection if the application seeking leave to defend filed by Respondent No. 1 is also considered on its merits as the impugned judgement had dismissed the application seeking leave to defend filed by Respondent No.1 only on the ground of limitation. Parties are directed to appear before learned Additional Rent Controller on 06.04.2016.

The Trial Court shall endeavour to dispose of the application expeditiously.

With these directions petition disposed of.
