Mr. Jagjit Singh, Senior Standing Counsel for Railways submits on instructions that the matter may be remanded back to the Appellate Authority for giving an opportunity of hearing and for passing a fresh order in the matter.

With the consent of both the parties, the impugned orders dated 10th March, 2016 is hereby set aside and the petitioner's appeal is remanded back to the Appellate Authority for fresh consideration. The Appellate Authority shall afford an opportunity of hearing to the petitioner and thereafter, pass a fresh speaking order. The respondent shall withhold coercive action against the petitioner till the disposal of the appeal by the Appellate Authority. 3.
The appeal and the pending application are disposed of in the above terms.
