% 31.01.2017 CM Appl. 43191/2016 Since Ms. Kumud Devi is already a party to the present proceedings, the present application filed for her impleadment is dismissed as infructuous.

CONT. CAS(C) 366/2016 & CM Appl. 13057/2016, 43244/2016 Since the second demolition notice has been stayed by the ATMCD at the instance of respondent No. 3, learned counsel for the petitioner wishes to withdraw the present contempt petition with liberty to file an impleadment application before the ATMCD.

Keeping in view the aforesaid prayer as well as the order dated 16th January, 2015 passed by a coordinate Bench of this Court in WP(C) 422/2015, the petitioner is given liberty to assist the ATMCD in the proceedings filed by respondent No. 3. However, in the event, respondent No. 3's appeal is dismissed by the ATMCD or the interim protection granted is vacated, the petitioner is also given liberty to file fresh contempt proceedings.
