% 20.01.2017 The learned counsel appearing on behalf of the respondent referred to the arbitration clause as contained in the agreement filed along with the reply. She states that the respondent will appoint an independent Arbitrator within a period of two days from today. In view of the same, the learned counsel for the petitioner does not press this petition. The respondent is bound down with the statement that the respondent will appoint an independent Arbitrator not connected with the respondent and with due regard to the provisions of Schedule V and VII of the Arbitration and Conciliation Act, 1996 read with Section 12 of the Act. The petition is disposed of.
