After arguments, this appeal is disposed of with the consent order by setting aside the impugned judgment dated 21.3.2018 dismissing the leave to defend application but the appellant/defendant will positively file his written statement within a period of four weeks from today before the concerned trial court with an advance copy to the counsel for the respondent/plaintiff.

Both the parties will not get more than three opportunities each to complete their evidence in chief, failing which right to lead evidence shall stand closed. Trial court is requested to expedite the RFA No.377/2018

disposal of the suit and to ensure that final arguments are completed in not more than three months after the first date fixed after completion of evidence.

Parties to appear before the District & Sessions Judge, Shahdara District, Karkardooma Courts, Delhi on 8th February, 2019 and the District & Sessions Judge will now mark the suit for disposal to a competent court in accordance with law and the observations made in the present order. 3.
