% 28.04.2016 Present writ petition has been filed challenging the order dated 25th February, 2016 passed by respondent No.1-NCTE whereby petitioner-Institution's application for grant of recognition for B.Ed. Course has been rejected on the ground that petitioner-Institute did not confirm that it was ready for inspection. Learned counsel for the petitioner has drawn this Court's attention to the order dated 8th September, 2015 passed by the Eastern Regional Committee in its Meeting dated 23rd April, 2015, wherein it is recorded that at the request of the petitioner, the time limit for inspection had been extended by 30 days. He further states that upon expiry of 30 days, the petitioner vide letters dated 27th August 2015 and 7th September, 2015 requested for inspection to be carried out, but no inspection had been carried out by the respondents till date. Though learned counsel for the respondents disputes the receipt
of letter dated 27th August 2015 and 7th September, 2015, yet this Court is of the view that the inspection of the petitioner-Institute should have been carried out in accordance with the decision taken by the ERC in its 186th Meeting.
Consequently, the present writ petition is disposed of with a direction to ERC to carry out inspection of the petitioner-Institute within a period of 60 days from today.
However, it is clarified that this Court has not expressed any opinion on the merits of the controversy. Rights and contentions of all parties are left open.
