O R D E R

% 10.05.2016 Present writ petition has been filed seeking a direction to respondents No.1 and 2 to rectify and update the petitioner's name from SHEETAL VERMA to SHEETAL, her father's name from RAM GOPAL VERMA to RAM GOPAL SINGH and her mother's name from SMT. SAVITRI VERMA to SMT. SAVITRI DEVI in their official records and accordingly issue corrected Grade Sheet-cum-Certificate of performance for the academic year 2010-2012 (Matriculation Certificate). A perusal of the file reveals that petitioner's representation dated 12th September, 2013 has not been disposed of till date. Learned counsel for respondent No.1-CBSE states that petitioner's

representation could not be disposed of as the petitioner's school has not forwarded the necessary information.

This Court is of the opinion that the stand of CBSE is untenable in law as CBSE is also a Regulator and is not powerless. Consequently, present writ petition and application are disposed of with a direction to the respondents to decide the petitioner's representation dated 12th September, 2013 at page 38 of the paper book within a period of eight weeks by way of a reasoned order.

However, it is clarified that this Court has not expressed any opinion on the merits of the controversy. Rights and contentions of all the parties are left open.
