% 16.03.2016 The claim in this writ petition was for a direction to the respondents to quash the order dated 11.06.2014, process the membership claim of the petitioner and allot a flat to him. During the pendency of these proceedings and pursuant to orders of the Court, the Registrar Cooperative Societies (RCS) has examined the materials on record and cleared the petitioner's case. Thereafter, the Delhi Development Authority (DDA) - which was directed to process the matter and hold a draw of lots, did so. It has informed today that the petitioner has been allotted Flat No. B-61 in the Roop Villa Cooperative Group Housing Society Ltd., Dwarka, New Delhi [hereafter "the Society"]. The Society is accordingly

directed to furnish the Occupancy Certificate. The petitioner submits that the Society has claimed maintenance and certain other expenses which are not justified. This Court cannot go into the correctness of those charges. Subject to deposit of the same, it is open to the petitioner to seek remedies in respect of the said charges or their legality in accordance with law. If any amount is deposited (which or part of which is disputed), the same shall be treated without prejudice to the petitioner's claim in that regard.
