% 26.04.2018 After some hearing, the counsel for the petitioners, on instructions, submits that he may be allowed to withdraw the present petition and the application filed therewith, petitioners reserving their contentions to be agitated at the trial, which is pending before the additional rent controller (ARC).

Learned counsel at the same time submitted that the eviction petition was filed in the year 2012 for purposes of then 23 years old educated son of the first petitioner, who has since passed away. He requested that the directions may be given to the ARC to expedite the proceedings. Learned counsel for the respondent submits no objection to this request, adding he would fully co-operate with the trial Court for expeditious disposal. The petition and the applications filed therewith are dismissed as withdrawn.

The additional rent controller is directed to proceed with the case expeditiously.
