% 07.05.2019 Vide the instant petition, the petitioner challenges his transfer order dated 13.04.2018 and communication dated 12.03.2018, whereby it is communicated to the petitioner by respondent No. 3 that he is not appointed as 'Appointed Actuary'.

It is not in dispute that pursuant to advertisement dated 01.01.2018, respondent No. 4 was sought to be appointed as 'Appointed Actuary' whose proposal was not approved by the Regulator, therefore, he has not been appointed as 'Appointed Actuary'.

Learned counsel appearing on behalf of respondent No. 1 has stated that if the further process will take place for the appointment as 'Appointed

Actuary', the candidature of the petitioner shall also be considered if he applies pursuant to the subsequent advertisement. It is not in dispute that pursuant to transfer order dated 13.04.2018, the petitioner has already appointed at RO Bhubanewar, thus, this issue is no more left in the present petition.

Second issue of the petitioner was that why he was not appointed as 'Appointed Actuary' as respondent No. 4 was sought to be appointed, but candidature of respondent no. 4 has not been approved by the Regulator. Therefore, in the present petition, nothing remains to be adjudicated. The present petition is, accordingly, disposed of. It is made clear that if any advertisement come for the appointment as 'Appointed Actuary' and the petitioner applies for the same, his candidature will be considered as per the procedure.

Further make it clear that if any harassment is caused to the petitioner, he will be at liberty to challenge the same before appropriate Forum. SURESH KUMAR KAIT, J MAY 07, 2019 rhc
