This application has been filed jointly by the parties to the suit praying that the suit and the counter claim be decreed in terms of the Settlement Agreement dated 02.09.2024 executed between the parties before the Delhi High Court Mediation and Conciliation Centre. 2.

The application, the affidavits in support of the application, and the said Settlement Agreement have been signed by the parties. The parties are personally present in Court and have been identified by their respective counsels. They affirm that they shall abide by the terms of the said Settlement Agreement.

I have also perused the terms of the Said Settlement Agreement and find the same to be lawful.

Accordingly, the application is allowed.

The suit and the counter claim are decreed in terms of the Settlement Agreement dated 02.09.2024. Let the Decree sheet be drawn accordingly.

It is hereby noted that the counsel for the defendant has handed over a demand draft dated 02.09.2024 of Rs.16 lacs to the plaintiff, who is present in person.

The learned counsels for the parties wish to express their special gratitude to the learned Mediator, Mrs. Veena Ralli, who they say has taken extra pains to ensure that the parties arrive at an amicable settlement and resolve their dispute, which was pending before this Court since the last 12 years.

The learned counsels for the parties also pray for return of the Court Fee as the suit has been settled in the mediation proceedings. 9.

The parties shall be entitled to the refund of the Court fee in the suit and the counter claim. The Registry is directed to prepare the Certificate of Refund and let the same be handed over to the respective counsels.

The next date of hearing, that is, 07.10.2024, shall stand cancelled.
