The petition seeks a direction to the respondent New Delhi Municipal Council (NDMC) to allow the petitioner to earn livelihood temporarily by vending from Gate No.4 of Palika Bazaar.

Though the respondent NDMC in response to the earlier writ petition being W.P.(C) No.9420/2015 filed by the petitioner had conceded to the relief claimed by the petitioner but the counsel for the respondent NDMC appearing on advance notice states that the no objection given therein was to the petitioner continuing at the site which he was then occupying in front of Hotel Connaught and no permission allowing the petitioner to vend from Gate No.4 of Palika Bazaar can be given for security reasons.

I am otherwise also of the opinion that now when the respondent has started issuing the identity cards to authorized vendors, if any such interim or final orders as are sought are passed, the same would interfere with the allocation of sites by the respondent NDMC to authorized vendors. 4.
The petition is disposed of with liberty to the petitioner to stake his claim before the Town Vending Committee.
