CM APPL. 41787/2019 (by the applicant/respondent No.3 for implementation of order dated 06.01.2016, 26.05.2017 & 01.08.2017) 1.

The present application has been filed by the applicant/respondent No.3 praying inter alia that the orders dated 06.01.2016, 26.05.2017 and 01.08.2017 passed in the present appeal may be directed to be implemented by the concerned Authority.

We may note that the appeal was disposed of vide order dated 01.08.2017 with only one caveat that in the event of non-filing of the LPA 236/2016

affidavits by the appellants, the Registry shall place the matter before the Court for appropriate orders and nothing else. 3.

In our view, the present application is not maintainable, more so, when under the garb of seeking implementation of certain orders, the applicant/respondent No.3 is seeking to re-open the matter which is impermissible. Thanks to such a misconceived application, the Registry has had to reconstruct two sets of the entire appeal paper book that has been weeded out after disposal.

At this stage, learned counsel for the applicant/respondent No.3 states that he may be permitted to withdraw the application.

The applicant/respondent No.3 is directed to deposit a sum of Rs.1,000/- in the Registry towards the expense incurred for preparing paper books within one week.

The application is disposed of with liberty granted to the applicant/learned counsel for the respondent No. 3 to seek legal recourse as may be available, to him.
