% 22.04.2016 Crl.M.A.No.6337/2016 Allowed subject to just exceptions.

The application stands disposed of.

Crl.M.C.No.1480/2016 and Crl.M.A.No.6336/2016 The present petition has been filed under Section 482 Cr.P.C. for seeking quashing/necessary modification in the order dated 09.03.2016 passed by the Trial Court whereby a cost of Rs.1,000/- was imposed on the petitioner and the same was directed to be deducted from his salary.

The Trial Court was of the opinion that there is supervisory lapse on the part of the petitioner as he did not ensure production of complete case property during the trial and due to said negligent conduct which occasioned the delay in trial, besides wastage of precious time of the court, a cost of Rs,1,000/- was imposed on the petitioner and the said cost was directed to be recovered from the salary of the petitioner.

It has been submitted by the learned counsel for the petitioner that the petitioner was ignorant about the omission occurred during the proceedings before the Trial Court and seeks a lenient view in the matter.

In the given facts and circumstances of the case, the present petition is disposed of with a direction to Trial Court to hear the submissions of the petitioner and then pass an order. P.S.TEJI, J APRIL 22, 2016/dm
